i am still in tennessee visiting my mom.
I dont know what is going on in ark city too much, but i did take a look at the cop notes. i also posted a couple press releases on the site.
I wish i had come a couple weeks earlier. This is a very nice place when the leaves are turning in the fall.
They are about all gone now.
Ive not taken many pictures this trip, but may on my way home.
The blog and the site should be back to normal next week. it is 17 hours of driving total. i guess a person could drive that straight through, but ill split it into two days.

ReplyDeleteIf it is warm there, you might want to stay longer. It went from 72 on Saturday to 39 high today! What a contrast in the two days! I want our weather back, I was enjoying it immensely.

ReplyDeleteWell JJ, if you missed out, the city seems to be losing money, such as Creekstone paying a past due amount of $135,000 and blaming it on the software. I've been warning everyone I know to make sure they don't lose their water bill receipts because if they can lose payments from companies, then they might lose payments for sanitation and water services.
"On 11-13-09, Toy James Martin 28 of Ark City was observed by Stage employees and also a customer stuffing two shirts under his clothing in an attempt to conceal them and remove them from the store. Stage employees contacted the Arkansas City Police Department and officers arrived. Mr. Martin was still in the store. Officers made contact with him shortly after in the store and found one black t-shirt and also a red t-shirt near his feet where he was standing when they spoke with him.

How do you arrest someone for theft WHEN THEY'RE STILL INSIDE THE STORE???? NOTHING WAS STOLEN IF THEY DIDN'T LEAVE THE STORE WITH IT!!!!! The guy may have had the intent to steal the items, but he hadn't done so yet. He could say that his arms were tired from holding the stuff, and he planned to stop at the register and pay on his way out. This is first day at the police academy stuff.
The only thing that could make this okay is if he had walked out and the employees had brought him back in the store prior to the officer's arrival, but the article does not mention anything like that. I hope this guy has a decent lawyer.
LOL Did you ever see the movie Police Academy? Great movie you will have to watch it. Super Troopers is another one that is pretty good. They take real personality's of cops and embellish them to make them funny.Makes for pretty funny entertainment. Of course we have our own entertainment here in town why rent the movies?

ReplyDeleteI am hoping that there was something left out of the press release, because if they did go into the store and arrest the guy before he actually made it outside, that is not a theft. Either the PD needs to make better press releases, or the officers on scene need to know the elements of a crime.
ReplyDelete@10:57AM, Actually, the first poster on the subject is correct.. A theft does not occur until the person has left the store with merchandise they did not pay for.. or at least attempted to leave the store.. so maybe you should hold off on the name calling until you know more. No one said the guy didn't plan to steal, it's just that you have to wait until he actually does so before making an arrest. He could have changed his mind and put the items back before leaving. The smart thing would have been to wait outside the store to see if he left with the items.

21-3701. Theft.
(a) Theft is any of the following acts done with intent to deprive the owner permanently of the possession, use or benefit of the owner's property:
(1) Obtaining or exerting unauthorized control over property;
(2) obtaining by deception control over property;
(3) obtaining by threat control over property; or
(4) obtaining control over stolen property knowing the property to have been stolen by another.
...
(g) For purposes of this act, "shoplift" means any one or more of the following acts committed by a person without the consent of the merchant and with the intent of appropriating merchandise to that person's or another's own use without payment, obtaining merchandise at less than its stated sales price or otherwise depriving a merchant of all or any part of the value or use of merchandise:
(1) Removing any merchandise from the premises of the merchant's establishment;
(2) concealing any merchandise with intent to leave the premises with the merchandise;
(3) substituting, altering, removing or disfiguring any label or price tag;
(4) transferring any merchandise from a container in which that merchandise is displayed or packaged to any other container; or
(5) disarming any alarm tag attached to any merchandise.

I have to admit that #2) "concealing any merchandise with intent to leave the premises with the merchandise". Is a new one on me. That wasn't the case when I was on the job. But even so, how do you show intent to leave if they aren't allowed to leave? I guess if the dude is stupid enough to admit it?!?!
That being the case, when I shop at Kohls, and I put items in their little black cart and then put another item on top of it, I am technically "concealing" it. What if my hands are full, and I put something in my pocket to get it to the checkouts? What's to stop the law from sweeping in and arresting me?
Kentucky takes it a step further even, by taking out the intent. If you conceal anything (as in my examples), you can be guilty of shoplifting.
