Interesting story about men being busted at Bricks with Drugs.
Arkansas City police and EMS were at Brick's restaurant early Friday and found four men under the influence of prescription drugs and marijuana, Ark City police Capt. Tom Scott said.
Around 7:40 a.m., officers received reports that four unresponsive men were at the restaurant. After speaking with the men – one of whom was inside the restaurant, while the other three were in a vehicle parked outside – police determined they were under the influence of narcotics.
While trying to determine what drugs had been taken, police found a pill bottle of Alprazolam, a drug known best commercially as Xanax. Ark City authorities contacted Winfield police who said the pill bottle was taken in a burglary earlier in the morning.
Eventually, the men at Brick's acknowledged taking the pills and smoking marijuana. All four were checked by medical personnel but declined to be taken to a hospital.
Andrew Cushenberry was arrested for possession of marijuana and drug paraphernalia. Darren Miller was arrested for possession of stolen property.
The two men were taken to the Cowley County Jail.
The two other men were allowed to leave and were not named because they were not arrested.
Man! Can't even smoke weed and keep to yourself in Ark City without the pigs showing up.

DeleteI was there for the circus that occured. One gentlemen was passed out in a booth and was unable to be roused without painful stimulus. The other three were out in a car. When Chief Sean Wallace arrived, he attempted to rouse the first kid. It was then that 5 other police officers and ambulance and the fire department showed up. not sure if it was one of the waitress's that called it in. We were some what concerned that the guy was dead, the one that was left in the booth.

ReplyDeleteBoy do people do some really stupid things. I can only imagine "how" relaxed they must of been combining anxiety medicine and marijuana. I don't understand why the other 2 weren't arrested.
ReplyDeleteBecause being under the influence of drugs is not an arrestable offense, provided you're not driving. The law doesn't consider drugs that are in your system as being in your possession. So you can't be arrested for drug possession simply for being high. And if drugs are found in a group of people, but not ON any of them, one person can claim them and take the punishment.
ReplyDeleteJust like the law says you can't be arrested for possession of alcohol simply for being drunk, such as when minors are MIC, but the ACPD arrests them anyway. I have never understood how they get away with that. For one thing, how do you prove that the crime of consuming the alcohol took place in your jurisdiction, and not outside the city limits, or even in Oklahoma unless you see them do it? I think if it were challenged they would lose.

ReplyDeleteNo, having drugs in your system is not possession. You can look it up yourself. At least it wasn't when I quit law enforcement seven years ago. Of course, it is possible that the laws have changed since then, but I think I'd have heard about it if it had.

Hmmm....seven years ago. I just might know you then. Too bad you quit, but I think I understand. Alot officers it seems now a days can be difficult to talk to, unless you are their bud.
ReplyDeleteAnyways, if an officer had reasonable suspicion that a minor is under the influence, couldn't they test them? My daughter was asked to perform a breathalyzer test, because the deputy claimed she smelled like liquor, even though it was her perfume. Needless to say, she didn't wear that perfume anymore!
I wonder if drugs makes Brick's food taste better.

Actually, when I was on the job, my prosecutors would not charge a minor with consumption of alcohol by a minor unless they actually had alcohol in their possession AND on their breath. For the simple reason that the crime is CONSUMPTION of alcohol, and if it wasn't there with them, or you didn't see them drink it, you couldn't prove that it was consumed in your jurisdiction, OR that it was consumed illegally. Parents are still able to let their children drink beer under age in Kansas. What if a kid drank some beer with his parents and then went uptown with a little on his breath? The PD would charge them with MIC, even though the alcohol was legally consumed. I think around here we have a lot of the "well, that's the way it's always been done" attitude. It doesn't always fit with the letter of the law.
